The Case
On an appeal against the decision of the employment tribunal that the appellant was not disabled under s1 the tribunal erred in its assessment of the appellant and whether the respondent had been unreasonable in the circumstances of the case. Accordingly the matter would be remitted for rehearing before a freshly constituted tribunal.
