Sentencing - Conspiracy to steal and violent disorder - Original indictment alleging assault with intent to rob and affray changed before trial - Appeal against sentence - Whether sentences excessive.
On the facts, the sentences of nine years' imprisonment for the first defendant and seven years for the second and third defendants for the offences of conspiracy to steal and violent disorder were excessive in all the circumstances. Accordingly, on appeal, the sentences would be quashed and replaced with a total sentence of seven years for the first defendant and five years for the second and third defendants.
