The Case
An employment tribunal had failed to address the question of the range of reasonable responses open to the respondent employer when hearing a complaint of unfair dismissal brought by an employee under s98 of the . Accordingly, the tribunal had fallen into error in its decision and the matter would be remitted back to a fresh tribunal for a rehearing.
