The Case

An honest reliance on a point which turned out to be a bad point of law could, nonetheless, amount to what was a just and equitable reason for an extension of time under s68(6) of the . In the circumstances, however, although the respondent employee had relied on such a point, given that the tribunal had relied so heavily on previous authority which was no longer good law, the matter would be remitted.
