The Case
On an appeal against a decision to allow an extension of time to file a notice of appearance, the subsequent discovery of a letter applying for such an extension undermined the whole factual basis upon which the appeal had been allowed. Accordingly, it was not open to the appeal tribunal to hear arguments on the factual basis which the decision had been reached.
