Craig Ward, Baron of Lundie is a solicitor and partner at Craybeck Law LLP. He is also a writer and researcher. He has an MSc from King’s College London and a BA(Hons) in psychology. He is a member of the British Psychological Society, Solicitors for the Elderly and a visiting research fellow at King’s College London. He is a CEDR accredited mediator and conducts commercial and vulnerable adult mediations. Craig is a regular speaker around the UK and internationally on mental capacity law, the Court of Protection, managing vulnerable adults, elder mediations, commercial incapacity law and legal compliance. He enjoys country walking, flute playing and scuba diving. He is currently researching decision making.

This Practice Note, written by Craig Ward, sets out the reasons why an individual should consider making a separate business lasting power of attorney (LPA) to deal with their business assets and the circumstances in which it will be appropriate to make a business LPA (BLPA). The differences between sole trader businesses, partnerships, limited liability partnerships (LLPs) and companies are discussed, in particular the interaction between the BLPA and the partnership agreement or the company’s articles of association. Guidance is also provided on creating a BLPA.

This Practice Note, written by Craig Ward of Lundie, of Craybeck Law, provides an introduction to Retained Regulation (EU) 2016/679, the UK General Data Protection Regulation (UK GDPR) for LPA attorneys and Court of Protection deputies. It explains when attorneys and deputies will be data controllers (DCs) under DPA 1998 and the UK GDPR and sets out the obligations of attorneys and deputies as DCs. The Practice Note goes on to examine the issue of consent to data processing in the context of mentally incapacitated data subjects (DSs) (also protected persons or vulnerable persons) and looks at scenarios where an attorney or deputy might face a conflict of interest between their role as attorney/deputy and their role as DC. Guidance is also provided for attorneys and deputies on dealing with requests for disclosure.
