Timothy Sherwin

Timothy is a Chancery barrister with a particular expertise and interest in trusts, estates and Court of Protection work. He has appeared in a number of high profile private client cases, such as Re the X Trusts [2018] SC (Bda) 56 Civ, a major piece of international trust litigation; and Re Z [2018] EWCOP 9, a complex and high value Court of Protection dispute. In addition, Timothy is frequently instructed on cases which engage trust and equitable principles in a business context, such as Byers v Samba [2018] EWHC 3180 (Ch), one of the most important cases currently before the English courts dealing with the Hague Convention on trusts and the availability of equitable relief in respect of trusts over assets in jurisdictions which do not recognise trusts. He is comfortable dealing with and advising on all manner of conflicts of laws issues. Timothy's case load also encompasses applications under the Inheritance Act 1975, probate claims, claims for breach of fiduciary duty and the removal of trustees and executors, and disputes over trusts in respect of real property. Clients have described him as an 'excellent advocate whose performance in court is 'exceptional. Timothy has completed a 5-month secondment in the top-ranked trusts and succession department of a leading international law firm, where he handled and advised on a very wide range of domestic and international trusts and succession matters.
