Rod McKenzie


Rod McKenzie is one of the founding Partners of Harper Macleod and he specialises in Commercial Litigation, Planning & Environmental, Commercial Contracts and Employment, and Sports Law and is also extensively involved in Gambling and Mining and Minerals Law.

Rod has a wide range of experience and expertise in relation to employment and litigation matters, especially in the provision of advice in relation to professional negligence, banking, property related litigation, trade union and industrial relations matters as well as in relation to insolvency issues which are sensitive and/or complex.

Rod takes the lead in negotiating complex contracts for clients of the firm. Such matters have included for example commodities supply, software and commercial services, equipment and machinery supply, construction and numerous substantial contracts for the supply of services.

Some highlights of his recent experience include:

  • Rod acted in one of Scotlandâ??s most interesting Employment cases (Marshall & Others v Strathclyde Regional Council & Others), in relation to equal pay, which progressed to the House of Lords and in three of Scotlandâ??s leading TUPE cases all of which were the subject of successful (for our clients) appeals in the Court of Session.
  • Acting for clients in a range of commercial and professional negligence litigations in the Court of Session and Sheriff Courts.
  • He acts for William Hill Organization in relation to betting licensing and general litigation matters in Scotland and the north of England and advises them on all betting licensing issues.
  • He is the legal adviser to the Scottish Premier League and has acted for them in numerous litigations, disputes and contractual matters.
  • He has undertaken a number of investigations for a Scottish local authority and housing associations into the conduct of senior members of staff and members.
  • Achieving, what we believe is the only payment in Scotland of damages against a trade union, in relation to unlawful industrial action.
  • He has been the principal legal adviser to The Scottish Coal Company Limited, acting in relation to all planning & environmental law issues in connection with numerous open-cast coal sites across central Scotland including dealing with EIAs and associated Section 75 agreements.
