John Hayward Bates


John was called to the bar in 1973 and have been concerned with environmental law since 1985. He has published four books on the subject – UK Marine Pollution Law (1985), Water and Drainage Law (looseleaf) (1990 – 2011), UK Waste Law (1992) Marine Environment Law (with C. Benson) (1993) He also was a co-author of Liability for Environmental Harm (2004) He was chairman of the UK Environment Law Association 1991 – 1993.

Recent court appearances include Dobson v Thames Water which was group litigation of 1,000 + residents claiming nuisance from odour and mosquitoes at Mogden sewage treatment works resulting from the negligent design and operation of the plant. In addition to the expert evidence required of treatment processes and mosquito biology, the case was also concerned with the justiciability of these claims in the light of the statutory scheme of the Water Industry Act 1991.

He has also acted for Claimants in respect of compensation for flooding and advises on a range of environmental matters from air pollution to waste management issues.
